2. RIGHT TO “CALL HOME”; OPT-OUT. The Product will automatically contact GFI SOFTWARE if and when any of the following events occur: (i) the Product is successfully installed by you; (ii) you fail to install the Product successfully; (iii) the Product has been successfully configured; (iv) there are changes to the Product's license key; and (v) the Product is uninstalled. You may opt out of the Call Home feature by sending an opt-out request to GFI SOFTWARE at the email address set forth in Section 22. Unless you opt out, you hereby consent to this feature. GFI SOFTWARE has offices worldwide and you acknowledge and consent that when the Product Calls Home the data may be sent to any GFI SOFTWARE office or affiliate for processing, including locations outside of the USA and European Union.

This "phone home" policy is unacceptable and should be changed to opt-in.

I cannot recommend any software that silently "phones home" to any of my customers.

It is also a blatant lie, as the software phones home during installation, not only under the conditions listed.

erm, is this not covered by either

"(i) the Product is successfully installed by you; "

or

"(ii) you fail to install the Product successfully;" ?

Somehow I don't see any other outcome of an installation, so when you run an installation, either outcome is guaranteed, right?

If you want to opt-out of this please contact the email address in Section 22.  All that can be done at this point would be to submit a feature request for your requested change as this would require development.

That's a little sneaky of GFI. I don't like it. I am assuming this is all layed out in the software agreement that I never read?

How do you access this agreement after the install? How about putting up a link or procedure on how to access so everyone can see these paragraphs.

What is the email address from section 22?

I agree with the gentlemen above.  It would be much better to have us opt-in than have us opt-out. 

Consider this thread an active feature request.

The Call Home functionality present in GFI MailEssentials does not send any personal data to the GFI servers. The data that is sent to the GFI servers includes Product Code, Operation Code, Language selected during the installation, Evaluation Status, license key and a unique installation ID.
 
Operation Code can be any one of
 - Check for new updates
 - Check for new builds
 - Installation
 - Un-installation
 - License key change
 - Purchase request
 
 
The information sent allows GFI to provide customers with an improved service related to product and content updates.

Let's all take off our tinfoil hats and try a bit of reality.  Generic statistics / installation outcome is not big brother.  It's not that unusual for companies to tracked installation successes and size of installed base.  Calling home for license verification is pretty standard as well.  It's not as if it gathers unique, personally identifiable information (aside from license if you've purchased).  This is a complete non-issue for me.

It might be best to include the information on what information is being collected and transmitted alongside the notification of the Call Home policy.

Of course, not having the opt-out functionality actually working could be a legal issue in some instances as the feature shouldn't have been activated if opt-out doesn't actually work.

At least I know about it at this point and have some idea of what's supposed to be in the messages. It probably isn't important to my customers that you're sending that type of data, although they would have a fit if they saw the data going out from their servers and no one could explain to them what it was and why it was being sent.
